Heard Sri Devendra Kumar Dwivedi, learned counsel for the petitioner and learned Standing Counsel for the State.
By way of this petition, the petitioner wants that this Court may direct the respondent No.2 namely Sub Divisional Magistrate, Tehsil Bah, Agra to approve the proposal for allotment of the fair price shop in Village Basai Bhadauriya, Block Pinhat, Agra and also direct him to decide the representation made by the petitioner on 8.8.2018 within the stipulated time.
The prayers prayed by the petitioner are not as such which cannot be granted by this Court hence, granted.
This petition shall also form part of the representation which has already been made to the respondent No.2.
The word & “illegally”mentioned in the writ petition is not of a good taste hence, the same be deleted as it may cause prejudice to the petitioner himself.
Respondent No.2 shall decide the representation as well as the application made herein by the petitioner on or before 15.9.2018 and communicate the same to the petitioner herein.
With these observations and directions, this petition stands disposed off.
It goes without saying that this Court has not entered into merits of the case.
Petitioner, if still feels aggrieved, may apply for the revival of this petition.
