Court No. - 9
Case :- WRIT - C No. - 14908 of 2019 Petitioner :- Ashok Kumar Respondent :- State Of U.P. And Another Counsel for Petitioner :- Vikas Kumar,Kalp Dev Mishra Counsel for Respondent :- C.S.C.
Hon'ble Anjani Kumar Mishra,J.
Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The writ petition has been filed seeking the following ground-
"i)Issue an order or direction in the nature of mandamus, commanding the respondent no.2, i.e. Sub Divisional Magistrate, Sadar, District Muzaffar Nagar to decide the application of petitioner dated 25.03.2019 and disposed of the same within a time bound period as may be fixed by this Hon'ble Court in the interest of justice."
Perusal of the record reveals that some letter has been sent by the petitioner, allegedly to the Sub Divisional Magistrate, Sadar, District Muzaffar Nagar, praying for a demarcation. This letter stated to have been sent by Registered Post.
In my considered opinion, in case, petitioner is serious about getting demarcation, he may approach the Sub Divisional Magistrate, Sadar, District Muzaffar Nagar by an appropriate and proper application under Section 24 of the U.P. Revenue Code 2006, and not by means of registered letter, as has been done by him.
Subject to the above, this writ petition stands disposed of.
