Heard Sri Vidya Kant Tripathi, learned counsel for petitioners and learned A.G.A. for State respondent Nos. 1 and 2.
The contention of the counsel for the petitioner is that there is a civil dispute going on between the petitioner and respondent No.4. A copy of the partition suit is appended as Annexure-4 to the writ petition.
Prima facie no case is made out for quashing of the First Information Report.
However, the petitioner shall not be arrested in Case Crime No. 0146 of 2019 under Sections 452, 323, 504, 506 and 427 I.P.C., Police Station Badlapur, District Jaunpur till the submission of the police report under Section 173(2) Cr.P.C. However, the petitioner shall cooperate in the investigation.
