Heard Sri Ramesh Chandra Tiwari, learned counsel for the petitioner and learned Standing Counsel appearing for the respondents.
This petition has been filed with following prayers:-
I. Issue a writ, order of direction in the nature of mandamus commanding the respondent no. 4 to consider the claim of the petitioner in accordance with law and promote him on the post of Driver (special grade) and provide him Grade Pay Rs. 4600 admissible for the said post.
II. Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 4 to decide the representation dated 13.04.2018.
Learned counsel for the petitioner submits that during pendency of the petition order dated 18.9.2019 has been passed by the respondent no. 4, District Development Officer, Sonbhadra. Therefore, he may be permitted to withdraw this petition with liberty to file fresh.
The petition is accordingly stands dismissed as withdrawn with liberty aforesaid.
