Ashok Kumar Singh And Others vs State Of U.P.Through The ...

High Court Of Judicature at Allahabad|13 September, 2010

JUDGMENT / ORDER

Affidavit of services has been filed but it is defective in the sense that the opposite parties no. 6, 7 and 8 have been made opposite parties by name. There is no personal receiving before this Court which can indicate that the opposite parties no. 6, 7 and 8 have been served. Service has been affected on the Executive Engineer and the learned counsel for the petitioner says that the Executive Engineer has obtained the receiving on the dispatch register, that may be so, but it is not sufficient to presume service on opposite parties no. 6, 7 and 8.
On the request of learned counsel for the petitioner, one more opportunity is given to serve the opposite parties no. 6, 7 and 8 out side the Court. Let Dasti/summon be issued for the same.
