Heard Shri Ratnesh Kumar Singh, learned counsel for the petitioner and Shri Sujit Kumar Rai, learned counsel appearing for respondent no. 3.
This writ petition has been filed challenging the order dated 29.05.2018 passed by respondent no. 5.
Learned counsel for the respondents has pointed out that the petitioner has remedy under Section 128 of the U.P. Cooperative Societies Act against the said order before the Registrar. He has relied upon a judgment rendered by the Hon'ble Supreme Court in the case of Ghaziabad Zila Sahkari Bank Ltd. v. Additional Labour Commissioner and Others reported in 2007, 11 SCC page 756.
Learned counsel for the petitioner says that he may be given some time to file a representation.
Accordingly, this writ petition is disposed of with a direction to the petitioner to file his representation before the Registrar of the Cooperative Societies within a period of two weeks from today along with a certified copy of this order. The Registrar in turn shall consider and decide the representation within a period of three months thereafter.
