Heard Sri Girja Shanker Mishra, learned counsel for the petitioner, Sri Rameshwar Prasad Shukla, learned counsel for the Gaon Sabha/respondent no.8, learned Standing Counsel who represents respondent nos.1 to 7 and perused the record.
After deliberations at length learned counsel for petitioner has confined his arguments only with respect to prayer no.(ii) made in the writ petition, which is quoted below:-
"Issue a writ order or direction in the nature of mandamus directing the Chief Revenue Officer, Azamgarh (respondent no.7) to consider and decide the representation moved by the petitioner dated 06.07.2020 in accordance with law which is still pending before him"
It is submitted by learned counsel for petitioner that present matter is arising out of mutation proceeding decided by Chief Revenue Officer, Azamgarh, vide order dated 20.08.1999(Annexure No.8), which become final between the parties.
Petitioner has moved an application dated 06.07.2020 (Annexure No.15) for implementation of the order dated 20.08.1999 in revenue record. It is submitted that aforesaid application is still pending for disposal and till date no fruitful steps has been taken to decide the aforesaid application, for implementing the order dated 20.08.1999, passed by Chief Revenue Officer, Azamgarh.
In this conspectus as above, no useful purpose would be served to keep this matter pending, therefore, this court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to Chief Revenue Office, Azamgarh (respondent No.7), before whom application dated 06.07.2020 is pending disposal, to decide the same expeditiously, preferably, within the period of three months from the date in receipt of copy of this order.
It is expected that it should be decided by reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments.
The petitioner shall file computer generated copy of such order downloaded from the official website of High Court, Allahabad supported by an affidavit, which shall be verified by the concerned authority from the website of the High Court, Allahabad.
With the aforesaid observation, present writ petition is disposed of.
