On 03.11.2017, this Court while disposing of Writ -C No. 46880 of 2017 filed by the applicant, directed the authorities to conclude the inquiry against respondent no. 7 to the writ proceedings within three months from the date of production of certified copy of the order.
A perusal of the documents brought on record does not reveal that the order was served on the authorities, although it is suggested that the order was served along with covering letter dated 24.11.2017 on the basis of an endorsement on the said letter. However, this Court is unable to accept the same.
In the absence of cogent material to prove that the order was duly served upon opposite parties, this court does not inclined to proceed in contempt. However, it is left open to the applicant to serve a certified copy of the order of the Writ Court upon the concerned opposite party by registered post and in case, the decision is not taken as per the directions of the Writ Court, it shall be open to the applicant to move to this Court against by way of a fresh contempt application.
With the aforesaid observation, the contempt application is disposed of.
