Heard learned counsel for the petitioner and perused the record.
The present petition has been filed for direction upon the court concerned to decide application 6-C in Original Suit No.115 of 2018 (Ashok Kumar Singh Vs. Rahdey Lal and others), pending in the court of Civil Judge (Jr. Div.), Kanpur Nagar.
From the order-sheet of the case it appears that on 29th May, 2018, the court did not consider it appropriate to grant ex-parte injunction and therefore issued notice to the other side fixing a date for consideration of the injunction application. According to the learned counsel for the petitioner the other side has already put in appearance in the proceeding and the next date fixed is 3rd December, 2018.
Be that as it may, considering that the next date fixed is 3rd December, 2018, it is for the petitioner to press the injunction application on the next date fixed. In case there is any urgency, the petitioner is at liberty to move urgency application before the court below, after serving notice on the other side for preponing the date, if so advised.
With the aforesaid observation, the petition is disposed off.
