Heard learned counsel for the revisionist.
The instant revision is directed against the order dated 01.11.2018 passed by the Civil Judge (Senior Division) Budaun.
The revisionist filed a suit for cancellation of a registered sale deed. The defendant purchaser filed a counter claim, seeking a decree for eviction of the plaintiff.
An objection was raised regarding the sufficiency of court fees paid on the counter claim. The issues framed in this regard have been decided in favour of the respondent who has filed the counter claim.
Upon hearing counsel for the revisionist and upon a perusal of the impugned order, I do not find any illegality therein.
The Court has rightly observed that the counter claim is for a mandatory injunction and the court fees paid, therefore is sufficient.
The revision is therefore, without merit and is dismissed.
