Heard learned counsel for the petitioner and learned Standing Counsel for the respondent- State.
In pursuance of the order dated 12.12.2018 learned Standing Counsel has placed the instruction, which are supplied to him by the District Magistrate, Varanasi.
From the perusal of the instruction dated 19.12.2018 it is clear that there was certain encroachment on pond, Chak Road and on Nali.
According to the report of the Tehsildar given to the District Magistrate through S.D.M. it is clarified that the said encroachment has been removed and a warning was given to the encroachers that in future they should not encroached the public utility properties otherwise the action will be taken against them.
In view of the aforesaid, the petition is disposed of.
However, it will be open to the petitioner in case if even after the removal of the encroachment the respondents or any private person encroaches the public utility properties they may move an application to the District Magistrate, Varanasi, who will act upon on the said application and take appropriate steps / action.
The instruction supplied by learned Standing Counsel be kept on record.
