Affidavits have been exchanged and, therefore, this matter is being disposed of at the stage of admission itself.
Heard Sri A.R.Dube, learned Counsel for the petitioner and Sri Nimai Dass, learned Additional Chief Standing Counsel for the respondents-State.
It is on record that the petitioner has filed statutory appeal before the Deputy Transport Commissioner (Passenger Tax), U.P. Lucknow, respondent no.2 in the year 2017, which is pending since then.
We are of the view that the appeal of the petitioner may be decided within a period of three months on merits and in accordance with law after affording an opportunity of hearing to the petitioner. The period of three months will start from the date of communication of a certified copy of this order before the appellate authority.
For a period of three months or till the appeal of the petitioner is decided, whichever is earlier, no coercive action may be taken against the petitioner.
The Writ Petition stands disposed of. No costs.
Copy of this order be given to Sri Nimai Dass, learned Additional Chief Standing Counsel free of charges for communication and compliance.
