The delay of 17 days in filing the appeal is held to be sufficiently explained.
It is accordingly condoned.
Delay condonation application no. 4 of 2019 is allowed.
The writ petition was dismissed with the observation that as no one has turned up to press it, it appears that no one is interested to pursue this petition and the same has otherwise become infructuous. The petitioner has challenged this order by means of this Special Appeal.
The aforesaid order is not an order on merits rather an order which has been passed in default. The petitioner may apply for recall of the said order and may satisfy the Court for the reasons of absence and that the petition has not become infructuous.
In view of the above, the appeal is dismissed with liberty aforesaid.
