JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) SATURDAY, THE TWENTY SEVENTH DAY OF DECEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.40052 of 2014 BETWEEN Ashok Kumar Patra AND ... PETITIONER The State of Andhra Pradesh, rep. by its Principal Secretary, Stamps and Registration Department, Secretariat Buildings, Hyderabad and others ...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Petitioner, who purchased the land, in question, under sale deed dated 30.01.2012, vide document No.184/2012, seeks to alienate the very same land. He points out that at the time of registration of the aforesaid sale deed, the Revenue Divisional Officer (RDO) gave no objection certificate under his proceedings, dated 29.06.2010, which is part of the registered document No.184/2012 and in view of that there is no reason why the petitioner’s proposed sale deed is not accepted and processed by the Deputy Registrar, respondent No.3. Hence, this writ petition.
3. In view of the letter of the RDO giving no objection for registration of petitioner’s sale deed vide document No.184/2012, there is no reason to think of other supervening circumstance, which prohibits respondent No.3 from once again refusing to process the sale deed of the very same land, which petitioner wants to execute in favour of respondent No.3. Hence, respondent No.3 shall verify document No.184/2012 including the no objection, which is part of the said document, and on being satisfied that there is no objection certificate given, respondent No.3 shall act and process the sale deed proposed by the petitioner.
With the above direction, the writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
