Heard Shri Arun Kumar Tiwari, learned counsel for the petitioner and the learned Standing Counsel for the respondents.
Learned counsel for the petitioner submits that against the penalty order dated 02.02.2018 the petitioner has filed a departmental appeal dated 20.03.2018 before the respondent no.2, Commissioner, Kanpur Region, Kanpur by registered post dated 21.03.2018, copy of which has been filed as Annexure-14 to the writ petition. The prayer is for a direction to the respondent no.2 to decide the said appeal.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.2, Commissioner, Kanpur Region, Kanpur to consider and decide the petitioner's appeal dated 20.03.2018, Annexure-14 to the writ petition in accordance with law expeditiously preferably within a period of three months from the date a certified copy of this order is received in his office.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
