The present petition has been filed for seeking a direction to the Additional Civil Judge (J.D.) court No. 4, Gorakhpur to decide the Original Suit No. 5028 of 2017 (Pramod Kumar vs. Dinesh Chand) within a time bound frame.
On 27th of March, 2018, following order was passed:-
"Counsel for the petitioner is granted time to explain as to how Original Suit No. 129/2010 wherein, the petitioner claims to have filed a counter claim, came to be registered as Original Suit No. 5028/2017.
As prayed, put up as fresh on 29.3.2018."
Further, On 5th of April, 2018, this Court has passed the following order:-
"As prayed by learned counsel for the petitioner, put up this case as fresh on 23.4.2018 so as to enable him to comply with the order dated 27.3.2018."
Learned counsel for the petitioner submits that there are several mistakes in filing of the present petition and he may be permitted to withdraw the same with liberty to file a fresh petition.
Accordingly, the present petition is dismissed with liberty to the petitioner to file a fresh petition.
