Heard learned counsel for the petitioner.
This petition has been filed seeking a direction to Additional District Judge II Kanpur Nagar to decide SCC Suit No.97 of 2010 (Ashok Kumar Gupta vs. Sandeep Jain and another) within a stipulated time.
Considering the facts and circumstances of this case, without expressing any opinion on the merits of the case, this petition at this stage stands disposed of with liberty to the petitioner to move appropriate application before the court below for expeditious disposal of the case in the light of the judgment of the Hon'ble Apex Court in the case of Hameed Kunju vs. Nazim 2017 (8) SCC 611 in which it has been observed that the object of the rent laws all over the State is to ensure speedy disposal of eviction cases between the landlord and tenant and especially those cases where the landlord seek eviction for his bona fide need, which shall be considered and decided sympathetically, as expeditious as possible, in accordance with law and thereafter the Court below may proceed accordingly and decide the suit on its own merit, in accordance with law, expeditiously preferably within a period of nine months by giving short dates provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
No costs.
