JUDGMENT / ORDER

Heard learned counsel for the applicants and learned AGA for the State.
It has been contended by learned counsel for the applicants that the opposite party no.2 is the close relative and they are co-sharers in the property in question and civil litigation is going on between the parties before the appropriate forum.
The present matter is purely of civil nature. Issue notice to opposite party No.2 returnable within a period of four weeks. Learned AGA may also file counter affidavit within four weeks.
List immediately thereafter.
Till the next date of listing, no coercive action shall be taken against the applicants in pursuance of chargesheet No. 7 of 2012 dated 18.01.2012 under Sections 420, 147, 323, 504, 506 I.P.C, arising out of case crime No. 145 of 2011, Police Station Jewar, District Gautam Budh Nagar.
