The case has been taken through video conferencing facility.
Heard learned counsel for the petitioner as well as learned A.G.A. for the State and perused the record.
This petition under Section 482 Cr.P.C. seeks quashing of order dated 02.09.2019 passed by Additional Court No.6, Lucknow by which non-bailable warrants as well as notices of sureties have been issued against the petitioner and for quashing the entire proceedings of Case No.1455 of 2017 "Smt. Alka Singh Vs. Ashok Kumar Choudhary", subsequently numbered as Case No.5360 of 2017, under Section 138 of Negotiable Instrument Act, 1881.
Vide impugned order the non-bailable warrants against the petitioner has been issued.
Learned counsel for the petitioner submits that the petitioner wants to appear before the trial court, but due to present situation, i.e. spread of pandemic "Covid-19", he is unable to travel from Delhi to Lucknow as both places have high rate of infection. He, therefore, submits that petitioner may be granted sufficient time so that he may travel to Lucknow and appear before the trial court.
Considering the aforesaid submissions and taking into note the present situation, i.e. spread of pandemic "Covid-19", it would be appropriate to dispose of this petition with a direction that in case the petitioner appears/surrenders before the court below within one month from today and apply for fresh bail, the same shall be considered and decided in accordance with law.
For a period of one month from today, the operation and implementation of the impugned order dated 02.09.2019 shall remain stayed.
