Heard Sri Rakesh Kumar Tripathi, learned counsel for the petitioner and Sri Shiv Datta Yadav, learned counsel for the respondents.
The petitioner in the writ petition is seeking quashing of the order dated 26 Apri 2018 whereby he has been placed under suspension. The allegation in the suspension order is that the petitioner has committed serious irregularities while sanctioning various vehicle loan accounts and has purchased cheque/allowed TOD in various SB/CD in violation of the bank's guidelines. It is also alleged in the suspension order that the petitioner has sanctioned vehicle loan accounts for Rs.101.60 lacs and all the accounts are classified as NPA during the period from 30 June 2016 to 31 March 2017 and that he has also recommended sanction of another vehicle loan account of Rs.13.37 lacs for purchase of 'PAJERO' from the same dealer.
Considering the nature of the allegations against the petitioner, we are not inclined to interfere with the order of suspension. However, it is stated that till date, neither any enquiry has been initiated nor any Enquiry Officer has been appointed.
If that be so, this writ petition is disposed of with a direction to the respondents that if they contemplate to hold the enquiry, then they shall issue a charge-sheet to the petitioner within ten days from the date of receipt of a certified copy of the order passed today in their office and thereafter conclude the disciplinary proceedings within a period of three months thereafter.
Needless to state that the petitioner shall co-operate in the enquiry and no unnecessary adjournments will be granted to any of the parties.
