Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with a prayer that the Court below i.e. Civil Judge (Junior Division), Kanpur Dehat be directed to expedite the hearing and decide the application dated 24.3.2017 filed under Order 1 Rule 10 read with Section 151 CPC in Original Suit No. 921 of 2014 within a time bound period.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the Civil Judge (Junior Division), Kanpur Dehat to expedite the hearing of the aforesaid application and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of six months, provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present petition is finally disposed of.
