Heard Sri Vinod Singh, learned counsel for the applicant, Sri Irshad Hussain, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the applicant is employed in Cr.P.F. The complainant of the case though has deposed against the applicant but it was just for maligning his image.
Learned A.G.A. have vehemently opposed the prayer for bail and submitted that the relationship which was established by the applicant and the victim was on the pretext of marriage.
Taking into account the allegation levelled against the applicant in the FIR as well as in the statement of the victim u/s 164 Cr.P.C., without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicant Ashok @ Ashok Kumar involved in Case Crime No.253 of 2019, u/s 376, 506 IPC, P.S. Jahangirabad, district Bulandshahr.
Accordingly, the anticipatory bail application is rejected.
However, the applicant is at liberty to move bail application u/s 439 Cr.P.C., if so advised.
