Heard learned counsel for the applicant and learned AGA for the State.
It is alleged that 223 bottles of english whiskey which was manufactured in the State of Hariyana was recovered in a vehicle from the possession of accused applicant in Uttar Pradesh.
Learned counsel for the applicant argued that he has been falsely implicated in this case and there is no public witness of the alleged recovery. Moreover, the applicant is in jail since 2.5.2010.
I considered over the matter. Looking to the entire facts and circumstances of the case, I feel that a case of bail is made out.
Let accused applicant Ashok alias Vikki be released on bail in case crime No.203 of 2010 under Section 60/62 of Excise Act, Sections 420, 272, 273 IPC and Section 2/3 of U.P. Gansters and Anti Social Activities (Prevention) Act of P.S. Shikarpur, District Bulandshahr on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the Court concerned.
