Heard learned counsel for petitioner and learned Standing Counsel for the State-respondents.
This writ petition has been filed seeking the following among other relief:-
"I. quash the impugned order dated 10.12.2019 passed by the respondent no.
2 in Partition Suit NO. 154/2019 (Udaybhan Singh Vs. guman Singh and Others), Computer Case NO. T20190250305025 under Section 116 of U.P. Revenue Code, 2006, Mauja Karikan- I, Pargana Dhata, Tehsil-Khaga, District Fatehpur."
The petitioner seeks expeditious disposal of a partition suit filed in the year 2019.
Perusal of the order sheet of the proceedings sought to be expedited reveals that the written statement has not been filed. Issues have not been framed, neither parties have led their evidence.
In view of the above, without entering into the merits of the controversy between the parties, I dispose of the writ petition with a direction to the respondent no. 2, Sub Divisional Magistrate (in short 'SDM'), Khaga, Fatehpur to consider and decide the partition suit expeditiously, preferably within a period of 18 months from the date of production of a certified copy of this order before him.
