JUDGMENT / ORDER

ANTONY DOMINIC, J. The appellant, a defaulter to the respondent bank, filed the Writ Petition aggrieved by the recovery proceedings initiated against him. The Writ Petition was disposed of by the learned Single Judge directing the appellant to clear the interest outstanding in two instalments payable on 31.3.2014 and on or before 30.4.2014. He was also directed to that if payment is made and a representation is filed agreeing to repay the principal dues in a faced manner, the bank will pass orders thereon. The appellant states that though he made certain payments towards the aforementioned two instalments, the entire interest outstanding has not been cleared and the request now made is to allow the appellant to pay the balance interest liability now due in two instalments and also to allow him to make a representation as allowed by the learned Single Judge.

2. We heard the learned counsel for the respondent bank also.
3. Since the reasons stated by the appellant for non- compliance with the conditions imposed by the learned Single Judge are apparently those beyond his control, we are inclined to allow the appellant another opportunity to clear the interest due. Accordingly, we dispose of this appeal allowing the appellant to pay the balance interest due as of now in two instalments, which shall be paid on or before 30.6.2014 and 31.7.2014. Along with the instalment payable on or before 30.6.2014, the representation as directed in the judgment shall also be filed. The judgment of the learned Single Judge will stand modified to the above extent and all the other directions in the judgment will remain undisturbed.
The writ appeal is disposed of as above.
