Heard learned counsel for the applicants and the learned A.G.A.
This application is filed by the applicants for quashing the charge-sheet no. 293 of 2017 dated 17.06.2017 of Case No. 1602/IX of 2017 (Case Crime No. 239 of 2017), under Sections 498A, 323, 354, 504, 506 IPC and 3/4 of D.P. Act, P.S. Goverdhan, District Mathura, pending in the court of Additional Chief Judicial Magistrate/ AC.J/S.D-2, Mathura.
After arguing at some length, learned counsel for applicants submits that grievance of applicants would be sufficiently met in case bail application of applicants is considered expeditiously in accordance with law.
In view thereof, it is provided that if the applicants surrenders before the Court below within three weeks from today and applies for bail, the Court below will consider the same, in accordance with law in view of the observations made in the case of Lal Kamlendra Pratap Singh Vs. State of U.P. reported in [2009 (3) ADJ 322 (SC)].
For a period of three weeks, no coercive steps shall be taken against the applicants.
With the aforesaid, the application is disposed of.
