Ashique Ali vs Kerala

High Court Of Kerala|21 November, 2014

JUDGMENT / ORDER

The petitioner has obtained Consent from the Pollution Control Board and thereafter, quarrying permit. The Consent is expired. The petitioner submitted Ext.P5 application for renewal before the second respondent. It appears that the application has not been considered on the reason that there is a General Order imposing ban for issuance of quarrying permit without obtaining environment clearance certificate. The petitioner relies on Ext.P6 judgment.
In view of Ext.P6 judgment, there shall be a direction to the second respondent to take up the application and pass appropriate orders for issuance of Consent, within a period of four weeks without insisting environmental clearance. Till W.P.(C) No.31043 of 2014 2 then, no coercive steps shall be taken against the petitioner for want of Consent from the Pollution Control Board.
The writ petition is disposed of as above.
