(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) After hearing the learned counsel for the parties and after taking into consideration the fact that against the order passed by the Tribunal remanding the matter back to the original authority, when appeal has already been admitted by this Court, in our opinion, there should be stay of all further proceedings of the appeal pending before the Commissioner of Appeals, Central Excise which has been preferred against the order passed by the original authority on remand to avoid multiplicity of proceedings. We accordingly stay all further proceedings of the said appeal pending before the Commissioner of Appeals, Central Excise till the disposal of the main Tax Appeal No.1419 of 2011.
The application is thus disposed of.
