The case is taken up through video conferencing. It is accompanied with an application for urgency which on consideration is allowed.
Heard learned counsel for petitioner, learned Additional Chief Standing Counsel appearing on behalf of Opposite Parties no.1,2 and 3 and Mr. Julfikar Naqvi, learned counsel holding brief of Mr. Rohit Tripathi, learned counsel for opposite party no.4.
The writ petition has been filed seeking following relief:
"(i) Issue a writ, order or direction in the nature of Certiorari quash the Reservation list Item No.16, in respect of Village panchayat Pamparpur, Block-Maya Bazar, Tehsil-Sadar, District-Ayodhya from Schedule caste category and further also direct the opposite party no.2 and 3 to reserve the aforesaid village panchayat in pursuance of Government order dated 17.03.2021, contained in Annexure No.3 to this writ petition, in the interest of justice.
(ii) Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite parties to decide the representation dated 31.03.2021 in pursuance of the Government order dated 17.03.2021, which is contained in Annexure No 2 to this writ petition.
(iii) Any other order, or direction, which this court deem fit and proper under the circumstances of the case in favour of Petitioner be passed in the interest of justice.
(iv) Allow the writ petition with cost in favour of the Petitioner."
Learned counsel appearing on behalf of opposite parties have raised a preliminary objection regarding maintainability of the writ petition in view of election notification dated 26.03.2021 and the bar of maintainability of the petition, consequently under Article 243(O) of the Constitution of India.
This Court is in agreement with the preliminary objection raised by learned counsel for opposite parties and therefore the writ petition is dismissed.
