By order dated 24.5.2017 passed in Writ C No. 23070 of 2017 filed by the applicant, he was granted liberty to make representation before the Additional District Magistrate of the district, who is Chairman of the Committee constituted under Government Order dated 12.5.2016 raising grievance regarding non-payment of compensation. There was a further direction that the Committee shall consider the claim of the applicant and decide the same in accordance with the procedure prescribed, within time frame.
On matter being taken up today, Sri P.K. Giri, learned Additional Chief Standing Counsel has placed on record the decision taken by the Committee on 5.2.2018 wherein the applicant is held entitled to compensation. The Committee has directed the Irrigation Department to pay the compensation. He further states that the Irrigation Department has already made calculation of the amount payable to the applicant, and is awaiting sanction of budget from the Government to make payment to the applicant.
Having regard to the fact that the Committee has already taken decision in compliance of the order of the writ Court, this Court is not inclined to proceed any further in the instant matter.
The contempt application stands disposed of accordingly.
