Heard Sri Rajesh Kumar, learned counsel for the applicant, Sri J.P. Tripathi, learned AGA for the State and perused the record.
This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant seeking enlargement on bail during trial in connection with Crime No. 13 of 2019, under Section 392 of I.P.C registered at Police Station, Paryatan, District Agra.
As per prosecution case, on 21.4.2019, FIR was lodged by one Satish alleging in it that when he was returning after seeing Taj Mehal, two accused person came on motorcycle and snatched the 'Mangalsutra' of his wife.
Learned counsel for the applicant submits that co-accused Sunny@ Sonu and Nafees have already been granted bail by this Court and, therefore, he be also released on bail.
On the other hand, opposing this submission, it has been argued by the State Counsel that the case of the applicant is different from the co-accused as the applicant is habitual criminal offender. He submits that as many as eight cases of similar nature have been registered against the applicant.
Considering the criminal history of the applicant, I am not inclined to release the applicant on bail at this stage.
The bail application is, accordingly, rejected.
The applicant would be at liberty to revive his application after the evidence of victim.
