This writ petition has been filed by the petitioner, seeking a direction to the police authorities to conduct fair and proper investigation in respect of Crime No.0084 of 2018 for the offence under Sections 323, 354-A, 506 of IPC and Section 3 (2) (V) of SC/ST Act, Police Station Bela, District Auraiya.
Petitioner is a son of Late Ram Kesh, at whose instance FIR (Annexure-2) was registered against the private respondents under Sections 323, 354-A, 506 of IPC and Section 3 (2) (V) of SC/ST Act. Though FIR was lodged by Late Ram Kesh on 19.3.2018, but till date, nothing has been done against the private respondents and waiting for the result of the FIR, Ram Kesh was killed. Counsel for the petitioner, submits that the police ought to have completed the investigation on the report lodged by Late Ram Kesh.
State Counsel submits that the police authorities are under an obligation to complete the investigation in a fair manner and, if the same has not already been done, would be done expeditiously in accordance with law.
The present petition is disposed of, expecting police authorities to conclude the investigation of the aforesaid case fairly and impartially, in accordance with law, on the basis of evidence so collected as expeditiously as possible.
