The present bail application has been filed by the applicant in Case Crime No. 243 of 2017, u/s 498A, 306 IPC, P.S. Raipura, District Chitrakoot with the prayer for enlarging him on bail.
Having heard Sri P.K. Goswami, Sri Neeraj Srivastava, learned counsel for the applicant, learned AGA for the State and considered the dying declaration of the deceased recorded by ACM-I in which though she has stated that she had herself set on fire on account of torture and ill- treatment being meted out to her by her husband she had taken an extreme step.
In view of the allegation made by the deceased about the torture and ill- treatment by her husband, I do not find it to be a fit case for enlarging the applicant on bail at this stage.
The bail application is, accordingly, rejected.
However, it has been stated by the counsel for the applicant that the applicant is in jail since 11.10.2017. The trial court is directed to expedite the trial and conclude the same preferably within the period of six months from the date of production of the certified copy of this order before the trial court.
