Heard Ms. Apoorva Agarwal, learned counsel for the petitioner.
The prayer made in the present petition is to issue a writ of mandamus commanding the respondent no. 2 to grant fire arm licence to the petitioner in accordance with Rule 25 (1) (b) of the Arms Rules, 2016.
The petitioner is seeking grant of licence so as to transfer the gun licence in the name of the petitioner's father. The application, for the purpose, has been filed on 12.6.2018. It is demonstrated by learned counsel for the petitioner that the licence of the petitioner's father is renewed upto 31.12.2020.
A description with regard to the filing of the said application with the number has been given in paragraph 10 of the writ petition. It is contended that the application submitted by the petitioner in the office of the District Magistrate, Banda on 12.6.2018 has been numbered as 58/694.
In view thereof, without entering into the merits of the claim made by the petitioner, the present petition is being disposed of with the direction to the District Magistrate, Banda/licensing authority to decide pending application of the petitioner dated 12.6.2018, expeditiously, preferably within a period of three months from the date of submission of certified copy of this order after satisfying himself about the credentials of the petitioner.
It is made clear that the said application shall be decided strictly following the provisions as contained in Rule 25 (1) (b) of the Arms Rules,2016.
