The prayer of the petitioner is to quash the selection of sixth respondent for Retail Outlet at village Mandawar, District Bijnore and to reconsider allotment of said Retail Outlet.
It appears that the sixth respondent proposed setting up Retail Outlet on waqf land and, therefore, it was claimed by the petitioner that the sixth respondent was not entitled to be placed higher in the order of priority.
On 11.8.2021, a statement was made by Sri Vikas Budhwar, learned counsel for the respondent-Corporation, that after evaluation by the competent authority, the sixth respondent who was earlier selected for the retail outlet has been now placed in the third category group and, therefore, there is no chance of his selection. On that statement, the Court required Sri Vikas Budhwar to complete his instructions.
Today, Sri Vikas Budhwar has produced a letter, dated 14.7.2021, issued from the Head Office of the Hindustan Petroleum Corporation Limited, in which it has been stated that the sixth respondent has been placed in the third category i.e. a person who has not offered land.
Sri Manoj Kumar Sharma, learned counsel for the petitioner, thus, submits that the petition may be disposed of by requiring the respondents to reconsider the allotment by examining the claim of the petitioner qua other applicants.
As from the stand taken by the Corporation, it appears, the retail out has not yet been settled, it is but natural that its settlement process is still on and, therefore, the case of the petitioner would be considered at the appropriate stage. Hence, no specific direction is required, at this stage.
With the aforesaid observations, this petition is disposed of.
