Heard learned counsel for the petitioner, learned A.G.A for the State of U.P. and perused the record.
Under challenge is the F.I.R. relating to case crime No.13 of 2010, under sections 420,467,468,471 IPC.Police station -Hassanganj, district- Lucknow.
The FIR discloses commission of a cognizable offence therefore, it cannot be quashed.
Learned counsel for petitioner submits that he has a license for packing of atleast four brands of mustered oil. According to the FIR ten tins at the rate of 15 Kg each of mustered oil was recovered on which stickers of Bajaj brand of mustered oil was pasted for which, he had no authority. It is said that it is a trivial matter and on account of some confusion , the FIR has been lodged.
In view of the aforesaid facts and circumstances, this petition is finally disposed of with a direction that petitioner shall not be arrested in the aforesaid case crime number unless and until credible and cogent evidence is collected against him during the course of investigation, subject to his full co- operation.
