Petitioners are before this Court assailing the impugned cancellation list dated 24.1.2019 (annexure no. 1) and advertisement (annexure no. 6) for fresh appointment of salesman, dated 19.2.2019 in the daily Dainik Jagran by the office of third respondent.
At the very outset, Sri Devesh Vikram, learned Standing Counsel raised the objection that earlier the petitioners had approached to this Court against the impugned suspension order by preferring Writ-C No. 1735 of 2019 (Ashish Goel Vs. State of U.P. and 3 Others), Writ-C No. 1729 of 2019 (Ramgopal Goyal Vs. State of U.P. and 3 Others), Writ-C No. 2225 of 2019 (Pankaj Goel Vs. State of U.P. and 3 Others), Writ-C No. 2010 of 2019 (Dinesh Kumar Gupta Vs. State of U.P. and 3 Others), Writ-C No. 1952 of 2019 (Sohan Lal Vs. State of U.P. and 3 Others), Writ-C No. 1735 of 2019 (Ashish Goel Vs. State of U.P. and 3 Others), Writ-C No. 1693 of 2019 (Rakesh Singh Vs. State of U.P. and 3 Others) respectively. The said writ petitions were disposed of by this Court asking the Authority concerned to proceed in the matter and take a final call expeditiously and in case the cancellation order has already passed then the petitioners may prefer statutory appeal against the said order.
Once the objection is being raised, learned counsel for the petitioners on the basis of averment contained in the writ petition, states that no doubt the cancellation order has been passed in the matter but at no point of time, certified copy of the impugned cancellation order has been served upon the petitioners as such the petitioners are unable to approach the appellate forum.
In the facts and circumstances, without adverting on merits of the case and with the consent of the parties, the writ petition stands disposed of finally with a direction that in case the petitioner moves an application within a week's time from today, the Authority concerned would ensure the certified copy of the order impugned (cancellation order) be provided to the petitioners within three days time so that the petitioners may approach to the appellate forum within further week's time and the appellate authority is also expected to decide the appeal on its own merit expeditiously ignoring the delay and laches in filing the same but certainly after affording opportunity to all stakeholders in the matter.
Let a copy of this order be provided to learned counsel for the petitioners today on payment of usual charges.
