JUDGMENT / ORDER

1. The petitioner's Writ Petition No.12173 (S/S) of 2019 was finally disposed of by the writ-Court vide judgment and order dated 29.04.2019 as under:-
"Heard learned counsel for the petitioner, learned Standing counsel appearing for the respondent no. 1 and Sri N.C.Mehrotra, learned counsel appearing for the respondents no. 2 and 3.
By means of the present petition, the petitioner has prayed for payment of his gratuity and leave encashment along with interest. It is submitted that the petitioner has retired on attaining the age of superannuation on 31.12.2018 but despite lapse of months, the aforesaid dues have still not been paid.
On the other hand, Sri Mehrotra, learned counsel appearing for the respondents no. 2 and 3 submits that the payment of the aforesaid dues is under process and the same would be paid to the petitioner within a period of six weeks from today.
The aforesaid statement of Sri Mehrotra, learned counsel appearing for the respondents no. 2 and 3 is recorded and the present petition is accordingly disposed of."
3. Pursuant to issuance of contempt notice, a short counter affidavit/compliance affidavit of Mr. Jagdish Prasad, Managing Director, U.P. State Construction and Infrastructure Development Corporation Limited, Vibhuti Khand, Gomti Nagar, Lucknow has been tendered today in the Court by Mr. V.K. Agarwal, Advocate holding brief of Mr. Anuj Kudesia, counsel for the contemnor-respondent, which is taken on record.
Along with the aforesaid affidavit, copy of order dated 03.06.2019, whereby the petitioner has been paid the amount of gratuity and group insurance, has been placed on record as Annexure-1.
From perusal of the said order, it is evident that the petitioner has been paid Rs.20,00,000/- as gratuity and Rs.1,16,740/- as group insurance.
4. From perusal of order dated 04.06.2019 placed on record as Annexure-2 along with the said affidavit, it is evident that the petitioner had already been paid Rs.7,94,000/-. However, some recovery was to be made from the petitioner.
5. In view of the above, nothing survives in this contempt petition, which is disposed of as having been rendered infructuous.
Contempt notice stands discharged.
However, if the petitioner has any grievance with respect to non-payment of other dues, which according to him is due and payable to him, it would be open to him to initiate appropriate proceedings before the competent Court/authority, if he is so advised.
