1. Sri P.N. Pandey, learned counsel for petitioner, fairly submitted that grievance of petitioner is satisfied as during pendency of this writ petition on the basis of certain orders passed by this Court, reevaluation has been done and eight numbers are increased and marks sheet is accordingly corrected and provided to petitioner-student. Now the only grievance left with petitioner is that certain cost be paid to him for his harassment on the hands of respondents.
2. Considering the above submission, a cost of Rs. 1,000/- is awarded to petitioner to be paid by Secretary, Board of High School and Intermediate Education, U.P., Prayagraj by way of a draft in the name of petitioner within a period of four weeks from today.
3. Further, this Court vide order dated 22.03.2021 has directed the Board to hold inquiry. The relevant direction is reproduced as under:
"The Court further directs the Board to hold enquiry into the matter and fixed the liability of teachers who had examined the answer books originally and take appropriate action against them as may be permissible in law and submit its report alongwith results of the re- checking of the answer books of the above noted roll numbers by the next date fixed. The board will appoint subject expert teachers to examine and recheck the answer books of the above noted roll numbers within two weeks from today and shall submit report by 20th April, 2021."
4. A compliance affidavit on behalf of Respondents-2 and 3 has been filed by Sri G.N. Srivastava, learned Standing Counsel today, which is taken on record, wherein the details of steps taken by Board are mentioned. An inquiry was conducted and certain penalty was imposed to Deputy Head Examiner.
5. Considering the action has already been taken in pursuance of order of this Court, the writ petition is disposed of with aforesaid direction with regard to payment of cost to petitioner.
