The present petition has been filed seeking quashing of notification dated 20th March, 2018 issued by the Election Officer/Principal of Dayanand Vedic Degree College, Orai, Jalaun in respect of election of the committee of management of a degree college.
The petitioner has sought to raise various pleas against the election proceeding but he could not dispute that the election would have to be submitted for approval/recognition before the Vice Chancellor, who exercises such power under Section 2(13) of the U.P. State Universities Act, and, otherwise, at the time of registration of list of office bearers, even the Registrar can examine the issues raised and, if they are referable to the Prescribed Authority, may make a reference, under Section 25(1) of the Societies Registration Act, 1860.
Under the circumstances, at this stage, this Court does not consider it appropriate to interfere with holding of election. Accordingly, without expressing any opinion on the merits of the case, this petition is disposed of with liberty to the petitioner to ventilate his grievance before appropriate authority, in accordance with law, after the elections are over.
