(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) As such the award is dated 20th February, 2006 and will not be enforceable after expiry period of 30 days i.e. from 20th March, 2006. Reinstatement as per the order dated 19th March, 2012 is made as daily wagers but it appears that wages from 22th March, 2006 till the actual reinstatement have not been calculated as per the wages prevailing then i.e. from the year 2006 onwards till 2012 for daily wagers and the amount of arrears is paid on the basis of wages of Rs.1,750/- per month.
It is hardly required to be stated that the arrears is to be calculated on the basis of the wages prevailing from time to time i.e. March, 2006 till the actual reinstatement. Therefore, the respondent shall be required to pay difference by recalculating the aforesaid arrears of wages and pay to the applicants.
At this stage, Mr. Shah, learned advocate appearing for the respondent under the instructions states that the payment shall be paid within three weeks from today i.e. 9th July, 2012.
