JUDGMENT / ORDER

Shri Deep D. Vyas, learned advocate appearing on behalf of the applicant has stated at the Bar that as Shri D.D. Vyas, learned Senior Advocate is unwell and is not in a position to attend the Court and therefore, he has requested to adjourn the matter. Shri Sanjanwala, learned Senior Advocate appearing on behalf of the contesting respondent has submitted that as such interim relief is operating against his client and infact on last occasion Shri D.D. Vyas, learned Senior Advocate assured the Court that he will go on with the matter. However, ultimately he has left it to the Court to adjourn the matter inclusive of the contention on behalf of the respondent that the present Second Appeal is not maintainable.
Hence, stand over to 11th June 2012.
It is observed that on that day the Court may take up main Second Appeal for final hearing subject to availability of time. Registry is directed to call for the Record & Proceedings of the case from the trial Court if no received so far on or before the aforesaid date.
