JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Mr.KL Pandya, learned APP waives notice of Rule for the State.
The present application is for temporary bail preferred by the applicant-convict on the ground that he wants to make arrangement for his brother's treatment.
It appears from the papers produced that the brother is having some mental sickness. But the document so produced do not show any further details about the treatment to be provided to his brother.
Additionally, the convict on such ground is desirous to leave the limits of Gujarat State and wants to go to Madhya Pradesh.
Under these circumstances, we do not find that it would be a case of exercise of the discretion for releasing the convict on temporary bail. Hence, the application is not granted. Dismissed accordingly. Rule discharged.
