Heard learned counsel for the applicant, Sri Lavkush Kumar Bhatt, learned counsel for the informant and learned A.G.A.
As per prosecution case, the deceased aged about 14 years was caused to death by the applicant to mount pressure upon the informant and his daughter to compromise in the pending rape case lodged against the applicant of having committed the offence of rape against the daughter of the informant.
It is urged by learned counsel for the applicant that there is no evidence against the applicant; applicant is languishing in jail since 12.01.2018 and is entitled to be released on bail.
Learned A.G.A. and learned counsel for the informant have vehemently opposed the prayer for bail and submit that the main role has been assigned to the applicant and it is not in the public interest to enlarge the applicant on bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Arvind, involved in S.T. No. 244 of 2018, Case Crime No. 464 of 2017, under sections 302, 201 I.P.C., P.S. Baghwala, District Etah.
Accordingly, the bail application is rejected.
The trial court is directed to expedite the trial of the aforesaid case and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order, if, there is no legal impediment.
The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
