1. RULE.
Expedited. Mr. B.T. Rao learned counsel waives service on behalf of respondent no.1.
2. Pending final disposal of the petition, the impugned orders dated 03.05.2004 and 05.04.2011 passed by respondent no.1 and 3 respectively shall remain stayed on condition that the petitioner will deposit the entire amount, as directed by both the authorities below, with the Registry of this Court, within a period of four weeks from today. Failure to deposit the amount as aforesaid would automatically lead to vacation of interim relief and the respondent-authority shall be at liberty to take appropriate action against the petitioner in accordance with law.
3. An endeavour was made by learned counsel Mr. Rao to show that the petitioner is required to deposit the amount in question, along with interest and penalty, as provided under the Employees' Provident Fund & Miscellaneous Provisions Act, 1952. However, this Court is of the firm opinion that no directions could be issue, which may lead to traveling beyond the scope of the impugned orders. Hence, the aforesaid order is passed.
