Heard the learned counsel for the petitioners, learned A.G.A. and perused the material on record.
The F.I.R. discloses commission of cognizable offence. Therefore it cannot be quashed.
However, it is submitted that the offences under Sections 147, 354, 323, 452, 504, 506, 427 I.P.C. are triable by Magistrate and not so grave except Section 3 (1) (X) S.C./S.T. Act.
Learned A.G.A. has nothing to say substantial against it.
In view of the aforesaid facts and circumstances as an interim measure it is provided that till any credible evidence is collected against the petitioners, they (Arvind, Swami Nath, Vinod Pandey, Babloo and Kaushal Kishore Mishra) shall not be arrested in Case Crime No.4 of 2010, under Sections 147, 354, 323, 452, 504, 506, 427 I.P.C. and Section 3 (1) (X) S.C./S.T. Act, Police Station Khandasa, District Faizabad subject to their full cooperation in the investigation which shall go on.
With these observations this petition is finally disposed of.
