The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the order dated 16.09.2020 passed in Public Interest Litigation No. 897 of 2020 (Arvind Rai Vs. State of U.P. and Others).
Today when the matter is taken up, learned Standing Counsel for the opposite party placed instructions dated 18.10.2021 before this Court received from the office of the opposite party along with a decision taken in the matter by opposite party dated 08.10.2021 the same is taken on record and a copy of the same has also been provided to the counsel for the applicant.
It is argued by learned Standing Counsel for the opposite party that in compliance of the order of Writ Court, a decision has already been taken by opposite party on 08.10.2021 therefore, the order of the Writ Court has been fully complied with and no further cause of action would further survived and prays for dismissal of the present contempt application.
Heard learned counsel for the parties.
Since the order of the writ court has already been complied with, therefore, no further order is required.
Accordingly, the present contempt application is dismissed.
In case, the applicant is still aggrieved with the decision of the opposite party, he has a liberty to challenge the same before the appropriate forum.
