Heard learned counsel for the petitioner, learned Standing Counsel for the State and perused the record.
The present petition has been filed for a suitable direction to the learned Civil Judge (S.D.) Muzaffarnagar to expedite the proceedings of case no. 283 of 2006 (Shri Arvind Niketan (Regd.) Vs. Ishwar Chand Tyagi and others) pending in the aforesaid court, as expeditiously as possible.
No useful purpose would be served in keeping the present petition pending, which is finally disposed of with a direction to learned Civil Judge (S.D.) Muzaffarnagar to expedite the proceedings of case no. 283 of 2006 (Shri Arvind Niketan (Regd.) Vs. Ishwar Chand Tyagi and others), most expeditiously, preferably within six months from the date of receiving of certified copy of this order, in accordance with law, after hearing the concerned parties, without granting unnecessary adjournment to either of the party, in case, the proceedings of the aforesaid case, is not stayed by any Court.
With the above observations and directions, writ petition stands disposed of.
