The applicant is before this Court for initiating contempt proceedings against the respondents for disobeying the order dated 9.8.2018 passed in Special Appeal No.1421 of 2007 (Arvind Kumar Sinha v. State of U.P. & Ors.).
On the matter being taken up today, Shri Sanjay Kumar Singh, learned Additional Chief Standing counsel on the basis of instruction dated 07.05.2019 submitted that so far as the other consequential benefits except ACP are concerned, the same has been quantified and most of the payment is debited in the account of applicant and as far as the ACP benefits are concerned, the same has also been considered and relevant papers have already been sent to the State Government and as such, it is being submitted that every sincere effort is being made to accord the benefit in compliance of the writ court order.
Once such categorical averment has been mentioned in the aforesaid instruction, then this court is of the considered opinion that necessary steps have been taken for compliance of the writ court order and it is always expected that the benefit of ACP would be provided to the applicant expeditiously, preferably within a period of two months.
With the aforesaid observations, this application is disposed of at this stage with liberty to the applicant to move a fresh application, if the order is not complied with by the opposite parties within the stipulated time as aforementioned.
