The instant anticipatory bail application has been filed with a prayer to grant an anticipatory bail to the applicants, Arvind Kumar and Santosh Kumar Pathak, in Case Crime No.87 of 2017, under Sections- 419, 420, 467, 468, 471 I.P.C., Police Station- Suriyanwa, District- Bhadohi.
The office has found that the applicants have preferred application under Section 482 Cr.P.C. Nos.14267 of 2017 and 17616 of 2020 before this Court, but they have not brought on record any such order. Charge-sheet has already been submitted against them on 26.10.2019. There is nothing on record to indicate as to what has happened in the meantime before the court and whether the applicant has been declared as absconder or not.
In view of paragraph-43(8) of the judgement of this Court dated 5.4.2021 passed in Criminal Misc. Anticipatory Bail Application U/S 438 Cr.P.C. No.2110 of 2021 (Shivam Vs. State of U.P. and another), this anticipatory bail application is not maintainable.
It is accordingly rejected.
